These Terms and Conditions (“Terms”) govern your access to and use of the website [www.rkcabs.in] (the “Website”) and the taxi, cab rental, airport transfer, local, and outstation travel services (the “Services”) offered by RK Cabs, [legal entity name], having its registered office at [full registered address] (“RK Cabs,” “we,” “us,” or “our”).

By accessing the Website, making a booking, or availing our Services, you (“customer,” “user,” or “you”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Website and our Services immediately.

1. About Our Services

RK Cabs provides on-demand and pre-booked taxi and car rental services, including but not limited to:

• Local city rides and hourly rentals
• Outstation one-way and round-trip taxi services
• Airport and railway station pick-up/drop services
• Corporate and event transportation

Vehicle availability, routes, and fares are subject to change based on demand, location, traffic, and operational conditions.

2. Booking and Confirmation

• Bookings can be made through our Website, phone, WhatsApp, or authorized booking partners.
• A booking is considered confirmed only after you receive a confirmation via SMS, email, call, or WhatsApp from RK Cabs.
• You must provide accurate pick-up location, drop location, date, time, contact number, and passenger/luggage details at the time of booking. RK Cabs is not liable for delays or service issues arising from incorrect information provided by the customer.
• We reserve the right to refuse or cancel any booking at our discretion, including in cases of suspected fraud, abusive behaviour, or unavailability of vehicles, with reasonable efforts made to notify you in advance.

3. Fares, Payments, and Billing

• Fares are calculated based on distance, vehicle type, trip duration, time of travel, tolls, state taxes, parking, and applicable driver allowances/night charges, as displayed at the time of booking or as communicated by our team.
• Quoted fares may exclude tolls, state entry taxes, parking fees, and interstate permit charges unless explicitly stated as “all-inclusive.”
• Payment can be made via cash, UPI, debit/credit card, or online payment gateway, as available at the time of booking.
• Any additional distance, waiting time, or route deviation requested by the customer during the trip will be charged extra as per applicable rates.
• All fares are subject to applicable government taxes (GST), which will be added as per prevailing rates.

4. Cancellations and No-Shows

• Customers may cancel a confirmed booking free of charge up to [X hours] before the scheduled pick-up time.
• Cancellations made within [X hours] of the scheduled pick-up, or after a driver/vehicle has been assigned, may attract a cancellation fee.
• A booking will be treated as a “no-show” if the customer is not available at the pick-up location within [15–20 minutes] of the scheduled time without prior communication, and the applicable fare/cancellation charge may be levied.
• RK Cabs reserves the right to cancel a booking due to vehicle breakdown, driver unavailability, adverse weather, or circumstances beyond our control; in such cases, we will attempt to arrange an alternative vehicle or issue a full refund of any amount collected in advance.

5. Waiting Time and Flight/Train Delays

• A complimentary waiting time of [15 minutes] is provided for local pick-ups and [30–45 minutes] for airport/railway station pick-ups (calculated from actual landing/arrival time, where flight/train tracking is available).
• Waiting time beyond the complimentary period will be charged as per applicable waiting charges.

6. Customer Responsibilities

By using our Services, you agree to:

• Provide accurate personal and travel information.
• Treat drivers and vehicles with respect; abusive, threatening, or unsafe behaviour towards drivers or staff may result in immediate termination of the trip without refund.
• Not carry any illegal, hazardous, flammable, or prohibited items in the vehicle.
• Be responsible for your personal belongings; RK Cabs is not liable for items lost, damaged, or left behind in the vehicle, though we will make reasonable efforts to help recover lost items.
• Ensure the number of passengers and luggage does not exceed the safe seating/carrying capacity of the booked vehicle.
• Bear the cost of any damage caused to the vehicle due to the customer’s negligence, misuse, or intentional act.

7. Driver and Vehicle Standards

RK Cabs undertakes to:

• Deploy drivers holding valid, verified driving licenses and, where applicable, commercial permits.
• Maintain vehicles in roadworthy condition with valid registration, insurance, and fitness certificates as mandated under the Motor Vehicles Act, 1988.
• Take reasonable steps to ensure driver background verification and passenger safety.

However, RK Cabs cannot guarantee an entirely incident-free journey, as road transport carries inherent risks including traffic conditions, weather, and third-party actions beyond our control.

8. Liability and Limitation of Liability

• RK Cabs acts as a service provider (and, where third-party vehicle operators/partners are used, as a facilitator) for cab and taxi services and will exercise reasonable care in fulfilling bookings.
• To the maximum extent permitted by applicable law, RK Cabs shall not be liable for any indirect, incidental, or consequential loss, including missed flights/trains, business loss, or loss of personal belongings, except where such loss arises from our proven gross negligence or willful default.
• Our total liability arising out of any single trip shall not exceed the total fare paid by the customer for that specific trip.
• Nothing in these Terms limits liability that cannot lawfully be excluded under Indian law, including liability for death or personal injury caused by proven negligence.

9. Force Majeure

RK Cabs shall not be held responsible for delays, cancellations, or service failures caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, road closures, government restrictions, accidents, or civil unrest.

10. Website Use and Intellectual Property

• All content on the Website, including the RK Cabs name, logo, text, graphics, and design, is the property of RK Cabs and is protected under applicable intellectual property laws. You may not copy, reproduce, or use this content without our prior written consent.
• You agree not to misuse the Website, attempt unauthorized access to our systems, or use the Website for any unlawful purpose.

11. Amendments to Terms

RK Cabs reserves the right to modify, update, or replace these Terms at any time without prior notice. Continued use of the Website or our Services after such changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat.
